Terms of Service

1. Agreement to Terms

By placing an order through our credit file ordering service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.

The Service is operated by Now (AUST) Pty Ltd (ABN 59 111 630 963) ("we", "us", "our"), located at Suite 12, 104 Gympie Road, Strathpine QLD 4500.

2. Eligibility

To use our Service, you must:

  • Be at least 18 years of age
  • Be an Australian resident or have a legitimate need to access Australian credit files
  • Provide accurate and truthful information
  • Have the legal authority to order credit files on your own behalf (or on behalf of an authorised entity)

3. Service Description

We provide a credit file ordering service that facilitates the request and retrieval of credit reports from Australian credit reporting bodies, including Equifax, Illion, and CreditorWatch. We act as an intermediary to simplify the ordering process.

We do not guarantee the content, accuracy, or completeness of any credit report obtained. The credit reports are produced by the respective credit reporting bodies and their content is solely their responsibility.

4. Orders and Processing

  • Orders are processed within 1 business hour during business hours (Monday to Friday, 9am-4pm AEST), subject to verification requirements.
  • We may contact you to verify your identity or clarify order details before processing.
  • We reserve the right to decline or cancel any order at our discretion, including where we suspect fraud or where identity verification cannot be completed.
  • Processing times may be affected by credit reporting body response times, which are outside our control.

5. Pricing and Payment

  • All prices are in Australian Dollars (AUD) and include GST where applicable.
  • A card processing fee of 2.5% is applied to all orders to cover payment processing costs.
  • Payment is processed securely by Stripe. We do not store your credit or debit card details.
  • Your card will be charged at the time of order submission.
  • We reserve the right to change our pricing at any time. Price changes will not affect orders already placed.

6. Refund Policy

  • If we are unable to obtain your requested credit file(s), you will receive a full refund.
  • If you wish to cancel your order before processing has commenced, please contact us immediately on 07 3613 9700.
  • Once a credit file has been requested from the credit reporting body, the order cannot be cancelled and no refund will be issued.
  • Refunds, where applicable, will be processed to the original payment method within 5-10 business days.

7. Identity Verification

Credit reporting legislation requires us to verify your identity before requesting credit files on your behalf. By using our Service, you:

  • Consent to us collecting and using your identity documents for verification purposes
  • Warrant that all identity documents and information provided are genuine and belong to you
  • Understand that providing false or misleading identity information is a criminal offence under Australian law

8. Authorisation

By submitting an order and providing your electronic signature, you authorise Now (AUST) Pty Ltd to:

  • Request credit reports from the selected credit reporting bodies on your behalf
  • Access and handle your personal and credit information as necessary to fulfil your order
  • Share your information with the nominated broker (if applicable and if you have provided express consent)

9. Your Obligations

You agree to:

  • Provide accurate, current, and complete information
  • Not use the Service for any unlawful purpose
  • Not use automated tools, bots, or scripts to interact with the Service
  • Not attempt to gain unauthorised access to our systems
  • Not submit orders on behalf of another person without their express consent and authority

10. Limitation of Liability

To the maximum extent permitted by Australian Consumer Law:

  • Our liability for any claim arising from the Service is limited to the amount you paid for the relevant order.
  • We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service.
  • We are not responsible for the accuracy, completeness, or content of credit reports produced by credit reporting bodies.
  • We are not liable for delays caused by credit reporting bodies or third-party service providers.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee or right under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.

11. Intellectual Property

All content on this website, including text, graphics, logos, and software, is the property of Now (AUST) Pty Ltd or its licensors and is protected by Australian and international intellectual property laws.

12. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Queensland.

13. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
